Terms & Conditions

Welcome to Harmonic Online Store. By accessing the Site, you confirm your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.

1. Interpretation

1.1 In these Conditions:

"Customer" refer to the party identified in this agreement that will be supplied goods;

"Goods" refers to goods including hardware and software items to be provided by HARMONIC AV to customer;

"HARMONIC AV" refers to HARMONIC AV SDN.BHD;

"Conditions" mean the general terms and conditions set out in this document and (unless the context otherwise requires) any special terms and conditions agreed in writing between the Customer and HARMONIC AV;

"Contract" means the contract for the purchase and sale of Goods, howsoever formed or concluded;

2. General

2.1 Only when all the outstanding payments have been received by HARMONIC AV, then shall any goods be passed to the Customer.

2.2 HARMONIC AV reserves the right to cease supply of Goods to the Customer at anytime.

2.3 HARMONIC AV reserves the right to approve or reject any request to cancel or to reschedule a delivery.

2.4 Any cancellation of Sales Order after 30 days will incur an administrative charge of 10% of the total value of the goods.

2.5 All goods are to be collected within the 30 days of the agreed collection date. Any goods collected after this grace period will incur an administrative charge of 2% of the total value of the goods per month.

2.6 Further justification and verification is needed before a refund can be issued. In the event that the Goods is found to be faulty due to manufacture's defect, a 1 - to - 1 exchange is applicable within 7 days of the purchase date. No exchange will be made after this grace period but will be directed to Service Center, warranty terms will still apply. To be eligible for a return, your item Must be unused and in the same condition that you received it (product packaging included). Your item needs to have the receipt or proof of purchase.

2.7 HARMONIC AV only warrants goods purchased from HARMONIC AV itself. The company warrants all parts defective in material or workmanship during warranty period of 12 months from purchase date.

2.8 HARMONIC AV will, at our sole option, repair or replace any defective parts free of charge (Only if product is under warranty).

2.9 HARMONIC AV will not pay shipping or transportation charges from you to us.

2.10 All warranty period is deemed to have commenced from the date of receipt/delivery of the goods.

2.11 HARMONIC AV will not consider any claim for compensation, indemnity or refund until liability, if any, has been established or agreed with the manufacturer and where applicable the insurance company.

2.12 In any circumstances, HARMONIC AV reserves the right to claim against the customer for all loss or damages incurred in the breach of these conditions.

3. User Submissions

In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.

4. Order Acceptanceand Pricing

Please note that there are cases when an order cannot be processed for various reasons. HARMONIC AV reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verification or information, including but not limited to phone number and address, before we accept the order.

We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or bank account charged.

5. Price

The price of the Goods shall be the price stated in HARMONIC AV’s website at the time which the Customermakes its offer purchase to HARMONIC AV. The price excludes the cost of packaging and delivery charges, any applicable sales and services tax, value added tax or similar tax which the Customer shall be liable to pay to HARMONIC AV in addition to the price. Sales and service tax will be stated upon check out. Prices shown exclude instalation.

6. Terms of Payment

6.1 The Customer shall be entitled to make payment for the Goods pursuant to the various payment methods set out in HARMONIC AV’s website. The terms and conditions applicable to each type of payment, as contained in HARMONIC AV's website, shall be applicable to the Contract.

6.2 In addition to any additional terms contained in HARMONIC AV’s website, the following terms shall also apply to the following types of payment:

6.2.1 Credit Card

Credit Card payment option is available for all Customers. HARMONIC AV accepts all Visa and MasterCards, both Credit and Debit. All your credit card information are protected by means of industry- leading encryption standards.Please take note that additional charges may be incurred if you are using a non-Malaysian issues card due to Foreign Exchange.

6.2.2 Debit Cards

HARMONIC AV accepts all Malaysian Visa and MasterCard debit cards where subject to bank availability. All debit card numbers shall be protected by means of industry-leading encryption standards.

6.2.3 Online Banking

i. By choosing this payment method, the Customer shall transfer the payment for the Goods to a HARMONIC AV’s account for the total amount of the Customer’s purchase (including any applicable taxes, fees and shipping costs). The transaction must be payable in Ringgit Malaysia. HARMONIC AV, in its sole discretion, may refuse this payment option service to anyone or any user without notice for any reason at any time.

ii. For the time being, HARMONIC AV accepts online bank transfers from AmBank, Bank Islam, CIMB Bank, Hong Leong, Maybank, Public Bank, RHB, Alliance, HSBC, OCBC Bank, UOB, Standard Chartered, Affin, Bank Rakyat.

7.Vouchers

7.1 You may use promotional vouchers while making payment for Products on the Site. Specific details for promotional vouchers are listed below.

7.2 Promotional vouchers must be entered at the check out page online only. Physical presentation of vouchers to HARMONIC AV personnel/Delivery staff will not be accepted.

7.3 In the event of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection withredemption of that voucher on the Site, we are entitled to close your Account and/or require a different means of payment.

7.4 We assume no Liability for the loss, theft or illegibility of promotional vouchers.

7.5 In rare cases, HARMONIC AV may at its sole discretion discontinue or cancel any voucher previously issued and will not be responsible for any losses arising therefrom.

7.6 Conditions for the redemption of promotional vouchers:

From time to time we may distribute promotional vouchers that may be used only on the Site, which we will send to you either by email,direct message or post:

Promotional vouchers are valid for the specified period stated on the voucher, can only be redeemed once and may not be used in conjunction with other promotional vouchers and discounted items.

(b) Although we strive to ensure you can fully utilize your voucher codes, they are non-refundable and non-exchangeable for cash. 

(c) If you return an item which you have used a voucher on, you will not get a replacement voucher as vouchers are for one time use only.

(d) You may redeem only ONE voucher per promotional campaign. HARMONIC AV reserves the right to cancel any subsequent orders made by you using a voucher of the same promotional campaign.

(e) If you place an Order for a Product less than the value of the promotional voucher, no refund or residual credit will be returned to you.

(f) The credit of a promotional voucher does not accrue interest nor does it have a cash value.

(g) For cash vouchers stipulated for a RM xx sum, If you choose to return the product, you will not be refunded the value of the cash voucher. However if you paid partly with your own funds, this portion will be refunded.

8. Delivery/Performance

8.1 Delivery of the Goods shall be made to the address specified by the Customer in its order.

8.2 Any dates quoted for delivery of the Goods are approximate only. The time for delivery/performance shall not be of the essence, and HARMONIC AV shall not be liable for any delay in delivery or performance howsoever caused.

8.3 Goods will be sent via Skynet which will take approximately 5 workings days to receive the goods.

8.4 If HARMONIC AV has failed to deliver the Goods in accordance with the Contract or within a reasonable time, the Customer shall be entitled, by serving written notice on HARMONIC AV, to demand performance within a specified time thereafter, which shall be at least 14 days. If HARMONIC AV fails to do so within the specified time, the Customer shall be entitled to terminate the Contract respect of the undelivered Goods and HARMONIC AV will refund the cost of the undelivered Goods.

9. Risk and Property of the Goods

9.1 Risk of damage to or loss of the Goods shall pass to the Customerat the time of delivery or if the Customerwrongfully fails to take delivery of the Goods, the time when HARMONIC AV has tendered delivery of the Goods.

9.2 Notwithstanding delivery and the passing of risk in the Goods or any other provision of these Conditions the property in the Goods shall not pass to the Customer until HARMONIC AV has received in cash or cleared funds payment in full of the price of the Goods and all other goods agreed to be sold by HARMONIC AV to the Customerfor which payment is then due.


10. Insolvency of Customer

10.1 This condition applies if:

10.1.1 the Customermakes any voluntary arrangement with its creditors or becomes subject to an administration order or (being an individual or firm) becomes bankrupt or (being a company) goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction); or

10.1.2 an encumbrancer takes possession or a receiver is appointed of any of the property or assets of the Customer; or

10.1.3 the Customer ceases - or threatens to cease - to carry on business; or

10.1.4 HARMONIC AV reasonably apprehends that any of the events mentioned above is about to occur in relation to the Customerand notifies the Customeraccordingly.

10.2 If this condition applies then without prejudice to any other right or remedy available to HARMONIC AV, HARMONIC AV shall be entitled to cancel the Contract or suspend any further delivery/performance under the Contract without any liability to the Customerand if Goods have been delivered but not paid for the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary.
